• The purpose of personal data processing:
Consent statement
With the completed contact form, the user sends a message to the controller regarding the sale, purchase or lease of the real estate or signs up for a free consultation. Based on the obtained contact information, the controller responds to the user and/or sends him the appropriate dates for the meeting. By logging in, the user agrees that the controller processes and stores data in the database for the purpose of further communication, based on the legitimate interest of the company.
Communication is individual, which means that the user is not automatically placed on any e-mail list.
Conclusion and implementation of agreements
The controller processes the personal data of users within and for the purpose of implementing agreements, also for the purpose of concluding agreements, in the negotiation phase, after receiving the offer or request of the user. When a user concludes a real estate independant brokerage agreement, the purpose of personal data processing is to fulfill the obligations under the agreement (i.e. sale/lease of his real estate or search for real estate for the user to purchase or rent and/or to
order real estate agency services).
• Legal basis for the processing of personal data:
We will process your personal data on the basis of your consent in accordance with the requirements of the EU General Data Protection Regulation (GDPR) and the applicable law governing the protection of personal data.
In the event of an agreement between the user and the controller, we will process your personal data on the basis of the agreement.
• Information on transfer of personal data to a third country or international organization:
We do not forward your personal data to a third country or international organization.
• • Storage perion of personal data:
The provided personal data shall be stored and used only for as long as it is necessary to achieve the purpose of processing, or within the limitation periods for obligations that could arise from the processing of such personal data. After fulfilling the purpose of processing, the data is deleted or the access to them is blocked. At the end of the storage period, the data is deleted and destroyed.
• Information on the existence of individual rights:
We respect your privacy with the desire for a long-term and fair business relationship, so we pay special attention to the protection of your personal data.
The controller ensures that users exercise their rights without undue delay and in any case within 1 month of receiving such a request. The controller may extend the deadline for exercising the user's rights by a maximum of an additional 2 months, taking into account the complexity and number of requests. If the controller extends the deadline, he shall notify the user of any such extension within 1 month of receiving the request, together with the reasons for the delay.

Where there is reasonable doubt as to the identity of the user who submits a request in respect of any of his rights, the controller may request the provision of additional information necessary to verify the identity of the data subject.
If the data subject's requests are manifestly unfounded or excessive, the controller reserves the right to charge a reasonable fee or to refuse to act on the request received.
In accordance with sectoral legislation, the controller allows the exercise of the following rights in relation to the processing of personal data:
Right of access by the data subject
The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and other information, in particular the purposes of the processing and the categories of personal data concerned.
Right to rectification
The data subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement. The controller reserves the right to request the submission of a document stating that the personal data subject to processing is inadequate.
Right to erasure (‘right to be forgotten’)
The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay if there is no reason why the deletion of personal data is not allowed. The controller has a legal interest in keeping the data for a certain period of time (eg a legal requirement to keep certain data of the user, proving the fulfillment of the contractual obligation of the controller to the user and the user to the controller).
Right to restriction of processing
The data subject shall have the right to obtain from the controller restriction of processing in accordance with the prescribed purposes of processing. The data subject has the right to require the controller to process only personal data that are strictly necessary to achieve the purpose with which the user has agreed, unless the controller must process this personal data in accordance with the law.
Right to withdraw consent
The data subject shall have the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
Right to object
The data subject shall have the right to object, on the grounds relating to his or her particular situation, if he or she considers that the personal data received on the basis of a request for the exercise of his or her rights are not personal data requested or are not received.
The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

Right to lodge a complaint regarding the processing of personal data
Every data subject shall have the right to lodge a complaint regarding the processing of his personal data. The data subject may send a complaint regarding the processing of personal data to the e-mail address info@diamantnepremicnine.si or by registered mail to the company's headquarters. Any data subject to whom personal data relate also has the right to lodge a complaint directly with the Information Commissioner if he or she considers that the processing of personal data in relation to him or her infringes Slovenian or EU regulations in the field of personal data protection.
• Validity
The controller reserves the right to change the legal notice regarding the protection of personal data, about which users will be informed on the controller's website.
